Terms & Conditions

The following terms and conditions are legally binding on you as a customer being the person (“You” or the “Customer”) entering into the evaluation and sale agreement (“sale”) of used, or unwanted clothing (the “Clothing” or “Clothes”) to GenieRecycling.com which is a trading name of H.S. Wood (textiles) Limited (“GenieRecycling.com” or “we”, “us”, “our”) and/or a user of the GenieRecycling.com site.

Please note: If you are donating your clothes to a selected charity, any references to: 'sale', 'sell', 'sold', 'order', 'valuation', 'cheque', 'payment' or other similar terms, should be replaced for 'donation'.

Please read these terms and conditions carefully before entering into a Sale from our site. You should understand that by using our site or placing any request for an evaluation and/or sale with us you agree to be bound by all these terms and conditions listed below.

1. Information about us
www.GenieRecycling.com
is a site operated by H. S. Wood (Textiles) Ltd. Trading as GenieRecycling.com (“We”). We are registered in England and Wales under company number 1210525 and with our registered office at H. S. Wood (Textiles) Ltd. Park View Mills, Raymond Street, Bradford, West Yorkshire, BD5 8DT. Our VAT number is 743 3303 60

2. Requirements for use
You warrant to GenieRecycling.com that:
2.1 You are at least eighteen (18) years of age, and are a resident in the United Kingdom;
2.2 You have full authority to sell the Valuables;
2.3 The Clothing is sold freely without any liabilities, nor any adverse claims of any type whatsoever;
2.4 No illegal activity in any country has been involved in the handling or possession of the Clothing;
2.5 GenieRecycling.com will not break any law of the UK or any other country as a result of your sale;
2.6 You legally own the Clothing that you are sending to GenieRecycling.com with the intention of sale, and can provide proof of ownership if requested.
2.7 You are legally capable of entering into binding contracts; and;
2.8 The information you submit is truthful and accurate.

3. How the contract is formed between you and us
3.1 After you have completed the online form ordering a Genie Recycling Pack, which will include two Genie Collection Sacks, you will receive an email from us acknowledging that we have received your order. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to receive from us an evaluation of your Clothing. All orders are subject to acceptance by us, and we will confirm such acceptance to you by dispatching to you our Genie Recycling Pack (“the Dispatch Confirmation”). The contract between us (“Contract”) will only be formed when we send you the Dispatch Confirmation.

4. Shipping and Insurance
You warrant to GenieRecycling.com that:
4.1 When sending your clothing to GenieRecycling.com you will only use the Genie Collection Sacks that GenieRecycling.com provides otherwise we reserve the right not to provide a Valuation for the clothing returned NOT in the specific Genie Collection Sack provided.
4.2 Upon return of a Genie Collection Sack(s), if it is found to be inappropriately filled, under the minimum processing weight of less than 10kgs in total, prior to processing, GenieRecycling.com reserve the right to not provide a valuation.
4.3 The Genie Collection Sack(s) provided by GenieRecycling.com will already be insured for transportation. If Your Clothing requires higher insurance you must arrange this at your own expense. If you are using an alternative courier to carry our Genie Collection Sack(s), you are responsible for fully insuring your Clothing, and any claim against loss or damage must be made to this carrier.
4.4 A third party will be carrying the Clothing between GenieRecycling.com and You, the use of our specific National Courier will be the only way of ensuring that the Clothing was mailed correctly.
4.5 GenieRecycling.com reserves the right to reject and immediately return a Genie Collection Sack(s) back to sender if it looks as though it has been tampered with, such as damaged or opened, without any further liability to GenieRecycling.com.
4.6 GenieRecycling.com takes no responsibility for damage or loss of Your Clothing when being delivered by a third party.

5. Events Outside Of Our Control
5.1 We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by third parties or events outside our reasonable control or due to our compliance with any applicable laws or regulations (“Force Majeure Event”).

6. Valuation and damage
6.1 GenieRecycling.com purchases Clothing for the purposes of reselling.
6.2 You accept that the process of appraisal of your Clothing may result in damage to the material.
6.3 GenieRecycling.com will not accept clothing that is not modern and that shows any signs of damage, wear or tear including but not limit to; tears, rips, stains, holes, missing buttons/badges/labels/, worn or broken stitching, dampness, faded colours/logos/prints, broken zips, bobbling, deodorant/aftershave/perfume stains, animal hair, odour/smoke ridden or worn/scuffed materials. We DO NOT accept bedding, curtains, work uniforms, home made knit wear, sports uniforms (example, Judo suit), school uniforms, soft toys, towels, rugs, books, cd's, DVD's, games, tired/aged clothing, dressing gowns, ethnic clothing, multiples of the same item, trade stock items, personalised clothing (e.g. Stag T-shirts) and less than 10kgs in total, prior to processing of the collection pack. Please see the "What Genie Buys" page for the latest information on the accepted and not accepted clothing lists.

6.4 If a Genie Collection Sack(s) becomes lost/damage during transit we will make a payment to you based upon the following: If our National Courier provides us with independent 3rd party weight of the sack, we will provide payment based on 50p per kilo. If our National Courier is unable to provide a sack weight, we will provide a payment based upon the estimated maximum weight a collection sack can hold (as per Q & A's Postage Queries 9 is 15kg), which is £7.50.00 (15kg x 0.50p = £7.5.00) per lost sack..
6.5 Quality Clothing that shows no signs of damage, wear or tear as in 6.3 will in valued at 50p per kilogram. All items that are sent to GenieRecycling.com that we do not accept, stated in 6.3, will be valued at 0p per kilogram.
6.6 The Valuation provided by GenieRecycling.com is final and we do not provide a return service for your clothing.
6.7 GenieRecycling.com reserves the right to destroy any Clothing received that do not meet the criteria outlined in 6.3.
6.8 Photo-record system - Is no longer available due to the very large volumes of clothing we process on a daily basis, we are unable to provide photographic records.

7. Transaction process and payment, and business hours
7.1 GenieRecycling.com is open for business Monday to Friday 9am to 5pm excluding public and bank holidays.
7.2 If a Genie Collection Sack(s) is found not to include a fully completed payment form (the welcome letter provided), to be inappropriately filled with damaged, worn or torn Clothing as stated 6.3, or filled under the minimum processing weight of less than 10kgs in total, prior to processing then GenieRecycling.com reserve the right not to provide a valuation.
7.3 Upon receipt of your Clothing, GenieRecycling.com will assess your Clothing and send you an acknowledgement email of the valuation of your Clothing. This valuation is final and a cheque/PayPal/BACS payment will be processed/sent out within 24 hours of you receiving your valuation email. The date written on the cheque refers to its issue date and can take up to 5 business days to be delivered by Royal Mail 2nd class postage. A cheque processing fee of 50p (1kg of clothing weight is taken off the total weight at valuation) applies to all cheques and is taken from the total payment amount. BACS & PayPal do not have a processing fee (from Genie Recycling)and are free to use, however, PayPal may charge you for using their service - We have no control over any PayPal fees. Paypal payments will be processed within 24 hours by echeque. We do not accept responsibility for payments made to PayPal with incorrect email addresses. The email address provided when requesting your Genie Recycling Pack is used to process payment with PayPal. As stated by PayPal, if a transation is not claimed after 30 days, unclaimed transactions are automatically cancelled and payment will not be processed a second time by GenieRecycling.com. We do not accept responsibility for payments made via BACS with incorrect account details provided that are successfully processed by the BACS system and we will not reissue failed BACS payments a second time, as we have already been charged for processing the payment. If a BACS payment fails prior to the payment being processed (due to wrong account/sortcode being provided) we will send your payment via cheque instead. The processing of textiles is done as quickly as possible and we aim for 2-5 business days as the normal processing time, however, in circumstances beyond our control, such as weather, seasonal changes in clothing, courier issues, staff sickness etc processing, if necessary, may take longer than 2-5 business days.
7.4 From the information provided by yourself, if a cheque is made out to the wrong name a £12.00 charge will apply and will be deducted from the valuation price of your Clothing in order to cover the fee we are charged by our bank to cancel the incorrect cheque. If the valuation of your Clothing does not cover the fee for reissuing your cheque then no other cheque will be issued and your Clothes will be processed without payment.
7.5 If a cheque has been lost in the post we will reissue a replacement cheque as long as the name is the same as the previous cheque and as long as the cheque has not been issued more than 30 days since the date of issue. We can only reissue cheques 10 working days after they were originally posted, up to a maximum of 30 days of the original posting date. If after 10 working days your cheque has not arrived we will issue you with a new one – please call our Customer Services Team on 08432 897 442. If you receive the original cheque after you have requested a reissue please ensure that you return it to us as it will be cancelled and invalid. If you attempt to cash this cheque you may be charged.
7.6 Packages are only delivered to GenieRecycling.com on working days, which exclude public and bank holidays.
7.7 As GenieRecycling.com pays the delivery costs of collecting your Genie Collection Sack, if a collection is missed due to no fault of our National Courier, it is at the discretion of GenieRecycling.com if another collection request is allowed after the initial collection attempt has been missed.

8.0. Ownership and risk
8.1 Ownership and risk of the Clothing will only pass to us once the courier has made the collection of the Genie Recycling Sacks.

9.0. Claims procedures
9.1 If the situation arose where you want to issue a claim, please send full details of your claim with all supporting evidence to H. S. Wood (Textiles) Ltd. Park View Mills, Raymond Street, Bradford, West Yorkshire, BD5 8DT. On receipt of your claim, should there be any irregularities found and/or missing proof that the items were mailed to GenieRecycling.com, the claim will be denied. Ensure the above precautions are carried out in order for a claim to be approved.

10. Use of this website
10.1 Access to our site is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on our site without notice (see below). We will not be liable if for any reason our site is unavailable at any time or for any period.
10.2 We are the owner or the licensee of all intellectual property rights in our site, and the material published on it. Those works are protected by copyright laws and treaties around the world. All rights are reserved.
10.3 You may print off one copy, and may download extracts, of any page(s) from our site for your personal reference. You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs or any graphics separately from any accompanying text. You must not use any part or material on our site for commercial purposes without obtaining a licence to do so from us or our licensors. If you print off, copy or download any part of our site in breach of these terms of use, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.
10.4 You warrant and represent to us that:
10.5 You will not use this site to send, knowingly receive, upload, download, use or re-use any material unconnected to the purpose of the site;
10.6 You will not knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time bombs, keystroke loggers, spyware, adware or any other harmful programmes or similar computer code designed to adversely affect the operation of any computer software or hardware;
10.7 You will not impersonate any person or entity, provide faults or misleading identification or address information, or invade the privacy, or violate the personal or proprietary right, of any person or entity;
10.8 You will not access without authority, interfere with, or damage or disrupt any part of our site, any equipment or network on which our site is stored, any software used in the provision of our site or any equipment or network or software owned or used by any third party.
10.9 Where our site contains links to other sites and resources by third parties or displays adverts of third parties, these are provided for information only. We have no control over the contents of those sites or resources, and accept no responsibility for them or for any loss or damage that may arise from your use of them.

11. Indemnity
You agree to not hold GenieRecycling.com responsible for any/all liability, claim, losses, cost and legal fees (paid in arrears) which is a direct or indirect result of any kind of violation of these terms and conditions. This includes our third party couriers and/or other claims by other third parties. You also permit that You will completely defend and cover GenieRecycling.com, and its lawful successors from any adverse claim, and not hold any of the previously mentioned parties responsible.

12. Choice of law, waiver, and claims
12.1 Regardless of its conflict of law provisions, these terms and conditions will be governed by the laws of England and Wales and the parties submit to the exclusive jurisdiction of the Courts of England and Wales. GenieRecycling.com’s failure to put any right or condition of the terms and conditions into effect, will not be deemed as ignoring such right or condition. If any condition of the terms and conditions is found by a court of law to be invalid, the parties agree nonetheless that the court should try to give effect to the parties intentions as reflected in such condition and the other conditions of the terms and conditions still completely and effectively apply. You agree that without regard to any statute law to the contrary, any claim or cause of action arising out of or related to use of the services offered by GenieRecycling.com must be filed in less than one (1) year after such claim or cause of action arose or be forever barred. Any such claim or cause of action must be filed in the United Kingdom. GenieRecycling.com shall be entitled to reimbursement for any and all costs incurred by it in defending any civil action filed or attempted to be filed in jurisdiction outside of England and Wales, including but not limited to legal fees acquired by GenieRecycling.com.

13. Information collected
13.1 GenieRecycling.com collects the details provided by you on registration together with information we learn about you from your use of our service, transactions and your visits to our website. We also monitor customer traffic patterns and site usage which enables us to improve the service we provide our customers.
13.2 GenieRecycling.com will use your information to provide and personalise our service and to detect and prevent fraud. We will also use your contact details to communicate with you. We may use your information to send you news regarding GenieRecycling.com services and offers. We may contact you by post, email, telephone or fax for these purposes.
13.3 Please note that there may be instances where it may be necessary for us to communicate with you, in any event, for administrative or operational reasons relating to our service.
13.4 Your information may be passed to and used only by our affiliate companies. We will never pass your personal information to anyone else, except where we are required or permitted to do so by law.

14. Change of the terms & conditions and pricing
14.1 GenieRecycling.com is entitled to change or amend these terms and conditions at our sole discretion. We recommend that you visit the website www.GenieRecycling.com occasionally to ensure You have an up to date understanding of these terms and conditions.
14.2 GenieRecycling.com reserve the right to alter the pricing that we pay to customers at any time. Prices may rise and fall as neccesary, according to current market conditions.
